There are two levels of Military Courts in Canada, the Courts Martial and the Court Martial Appeal Court. These courts were established under the National Defense Act.
The Courts Martial has jurisdiction over cases involving the Code of Service Discipline. It applies to service members and civilians who accompany the Forces on active service.
It lays out systems of disciplinary offenses which challenge this specific goal; “to further the good and proper functioning of the Canadian Forces.”
Cases are heard by a panel of three. The judges in these cases are selected from Federal Courts and other Superior Courts. This court has the same powers as the superior courts. They hear appeals from the Military Courts.
